Consultation - New South Wales Public Spaces (Unattended Property) Act 2021

The NSW Government is developing regulatory proposals for a new Public Spaces (Unattended Property) (PSUP) Regulation 2022 to support commencement of the NSW Public Spaces (Unattended Property) (PSUP) Act 2021.

The NSW Office of Local Government (OLG) has released a Regulatory Impact Statement (RIS) for consultation on the preferred options for regulations to support the new Public Spaces (Unattended Property) (PSUP) Act 2021, which was assented to on 29th November 2021.

OLG has invited the AVA to provide comment on proposals in the RIS in relation to regulatory matters (stray stock and unattended animals) including Penalty Infringement Notice amounts, notice periods, monetary caps under which items may be quickly disposed of, and risk-based timeframes within which those responsible for unattended property in public must collect their property or potentially face strong enforcement action.
